1. About this Privacy Policy

WellnessCoWork is operated by Mark Anthony as trustee for the Mark Anthony Family Trust, ABN 30 781 343 672.

In this Privacy Policy, “WellnessCoWork”, “we”, “us” and “our” refer to Mark Anthony in his capacity as trustee for the Mark Anthony Family Trust, trading as WellnessCoWork.

This Privacy Policy explains how we collect, hold, use, disclose and protect personal information in connection with:

  • the WellnessCoWork website;
  • clinic, treatment-room, therapy-room and consulting-room listings;
  • enquiries between room seekers and room providers;
  • free, paid and Featured Listings;
  • emails, forms and communications sent through WellnessCoWork; and
  • any related services we provide.

This Policy applies to all people who use WellnessCoWork, including:

  • clinic owners;
  • practice managers;
  • room providers;
  • wellness and allied-health practitioners;
  • therapists, counsellors, coaches and other room seekers;
  • website visitors; and
  • people who contact us.

We aim to handle personal information consistently with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, where applicable.

2. What is personal information?

Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

Depending on the circumstances, this may include your name, contact details, business information, professional information, online activity and communications with WellnessCoWork or another user.

3. Personal information we may collect

3.1 Information from clinic owners and room providers

When you register, create a listing, purchase a Featured Listing or communicate with us, we may collect:

  • your full name;
  • email address;
  • telephone number;
  • business or clinic name;
  • business contact details;
  • clinic address and location;
  • suburb, state and postcode;
  • your position or relationship to the clinic;
  • ABN or other business details;
  • clinic and practice information;
  • room descriptions;
  • room pricing and rental arrangements;
  • availability;
  • minimum rental periods;
  • permitted room uses;
  • amenities, accessibility features and inclusions;
  • photographs, logos and other images;
  • information about practitioners already working from the location;
  • account login details;
  • records of listings created, edited, renewed or removed;
  • records of your acceptance of our terms, policies or agreements;
  • payment and billing information; and
  • correspondence between you and WellnessCoWork.

3.2 Information from practitioners and room seekers

When you search for a room, contact a clinic or submit an enquiry, we may collect:

  • your full name;
  • email address;
  • telephone number;
  • profession or area of practice;
  • preferred location;
  • type of room required;
  • preferred days, times or rental arrangement;
  • information you include in your enquiry;
  • details of listings you have viewed or contacted;
  • saved or shortlisted listings, where this feature is available; and
  • correspondence between you and WellnessCoWork.

3.3 Payment information

When you purchase a Featured Listing or another paid service, payment may be processed by a third-party payment provider.

The payment provider may collect your:

  • name;
  • billing address;
  • payment card details;
  • transaction details; and
  • fraud-prevention or verification information.

WellnessCoWork may receive limited payment information, such as:

  • payment confirmation;
  • transaction identification number;
  • payment date;
  • amount paid;
  • payment status; and
  • limited card information, such as the card type or final digits.

WellnessCoWork does not intend to directly store complete payment-card numbers or card security codes.

3.4 Information collected automatically

When you access or use our website, we may automatically collect:

  • your IP address;
  • browser type and version;
  • device type;
  • operating system;
  • approximate location derived from your IP address;
  • pages viewed;
  • searches performed;
  • links or listings selected;
  • the date and time of your visit;
  • time spent on pages;
  • referring websites or advertising sources;
  • error logs;
  • cookie identifiers; and
  • other technical and usage information.

3.5 Information received from other people

We may receive personal information from:

  • a clinic owner, manager, employee or authorised representative;
  • a practitioner making an enquiry;
  • someone acting on your behalf;
  • our payment, hosting, email or technology providers;
  • publicly available business sources; or
  • another person who believes you may be interested in WellnessCoWork.

Where someone provides information about another person, they must be authorised to do so or have a reasonable basis for providing that information.

4. Sensitive information

WellnessCoWork is a room-listing and connection platform. We do not require users to provide personal medical records, diagnoses, treatment histories or other sensitive health information.

Please do not include unnecessary personal health information in:

  • listing descriptions;
  • enquiry messages;
  • profile information;
  • uploaded documents; or
  • communications sent through WellnessCoWork.

Information about a practitioner’s profession, qualifications or services may be displayed where the practitioner or clinic chooses to provide it.

Where you voluntarily provide sensitive information, you consent to us handling that information for the purpose for which it was provided, unless the law requires otherwise.

5. How we collect personal information

We may collect personal information:

  • directly from you;
  • through website forms;
  • when you create or manage a listing;
  • when you purchase a Featured Listing;
  • when you submit or respond to an enquiry;
  • through email, telephone or other correspondence;
  • when you subscribe to communications;
  • through cookies and similar technologies;
  • from an authorised representative; or
  • from service providers who help us operate WellnessCoWork.

You may browse general parts of the website without identifying yourself. However, we may be unable to provide certain services if you do not provide the information reasonably required.

6. How we use personal information

6.1 Operate WellnessCoWork

We may use personal information to:

  • create and manage user accounts;
  • publish and manage room or clinic listings;
  • display clinic and room information in search results;
  • provide free, paid and Featured Listings;
  • process payments;
  • administer listing periods and renewals;
  • allow practitioners to search for suitable rooms;
  • facilitate enquiries between room seekers and room providers;
  • send enquiry notifications;
  • verify account or listing information;
  • moderate, edit or remove inappropriate content;
  • prevent misleading, duplicate or fraudulent listings; and
  • provide customer support.

6.2 Communicate with users

We may use your information to:

  • respond to questions and support requests;
  • send account and listing notifications;
  • confirm purchases or payments;
  • provide information about enquiries;
  • advise you when a listing is due to expire;
  • communicate changes to our services, terms or policies;
  • request feedback;
  • send administrative or service-related messages; and
  • communicate about disputes or complaints.

6.3 Promote WellnessCoWork

With your consent, or where otherwise permitted, we may use your contact information to send:

  • service announcements;
  • listing tips;
  • launch offers;
  • Featured Listing offers;
  • newsletters;
  • promotions; and
  • information about related WellnessCoWork services.

You may unsubscribe from non-essential marketing communications at any time.

6.4 Improve and protect the platform

We may use information to:

  • understand how people use WellnessCoWork;
  • improve website navigation and search results;
  • develop new features;
  • measure advertising or promotional performance;
  • maintain website security;
  • detect suspicious activity;
  • prevent fraud, spam or misuse;
  • troubleshoot technical issues;
  • produce aggregated or de-identified statistics; and
  • protect our users, business and systems.

6.5 Meet legal and business obligations

We may use personal information to:

  • comply with applicable laws;
  • maintain financial and business records;
  • enforce our terms and conditions;

7. Publicly displayed information

Information included in a listing may be publicly displayed and may be visible to:

  • website visitors;
  • search engines;
  • social-media users;
  • practitioners searching for rooms; and
  • other third parties.

Public listing information may include:

  • clinic or business name;
  • clinic location;
  • room description;
  • room photographs;
  • pricing;
  • availability;
  • amenities;
  • business contact information;
  • permitted practitioner types; and
  • other information selected for publication.

You should not include personal information in a public listing unless you are comfortable having it displayed publicly.

Search engines and third-party websites may retain cached or archived copies of information after it has been changed or removed from WellnessCoWork. We cannot guarantee the immediate removal of content previously indexed or copied by third parties.

8. Enquiries between users

When a practitioner or room seeker contacts a room provider through WellnessCoWork, we may provide the relevant room provider with information submitted in the enquiry, including:

  • the enquirer’s name;
  • email address;
  • telephone number;
  • profession or intended room use;
  • preferred rental arrangements; and
  • enquiry message.

By submitting an enquiry, the enquirer consents to this information being provided to the relevant listing owner or authorised representative.

The room provider may then contact the enquirer directly.

Once personal information has been disclosed to another user, that user may independently store and use it. WellnessCoWork cannot fully control information held by another user. Users must handle enquiry information responsibly and use it only for legitimate room-rental discussions or related purposes.

We encourage users not to disclose unnecessary sensitive, financial or identity information during initial discussions.

9. When we may disclose personal information

9.1 Other WellnessCoWork users

We may disclose enquiry details to the relevant room provider and display listing information to potential room seekers and the public.

9.2 Service providers

We may provide information to businesses that assist us with:

  • website hosting;
  • cloud storage;
  • database services;
  • account authentication;
  • payment processing;
  • email delivery;
  • website analytics;
  • security and fraud prevention;
  • customer support;
  • accounting;
  • marketing; and
  • professional advice.

These providers should only receive information reasonably required to perform their services.

9.3 Legal and regulatory disclosures

We may disclose information where required or authorised by law, including in response to:

  • a court order;
  • subpoena;
  • warrant;
  • regulatory request;
  • law-enforcement request; or
  • another valid legal process.

We may also disclose information where reasonably necessary to protect the safety, property or legal rights of WellnessCoWork, its users or another person.

9.4 Business changes

If WellnessCoWork or its assets are sold, transferred, merged, restructured or acquired, personal information may be transferred as part of that transaction, subject to applicable privacy requirements.

We do not sell personal information to data brokers.

10. Cookies and similar technologies

We are not responsible for the privacy practices, security or content of external websites or services. Users should review the privacy policy of a third party before providing personal information to it.

12. Storage and security

We take reasonable steps to protect personal information from:

  • misuse;
  • interference;
  • loss;
  • unauthorised access;
  • unauthorised modification; and
  • unauthorised disclosure.

Depending on the systems used, safeguards may include:

  • secure website connections;
  • password protections;
  • access restrictions;
  • account authentication;
  • system monitoring;
  • software updates;
  • secure third-party providers;
  • backups; and
  • administrative procedures.

No website, electronic transmission or storage system can be guaranteed to be completely secure. Users are responsible for protecting their account passwords and should notify us promptly if they suspect unauthorised account activity.

13. Overseas storage and disclosure

Some technology, payment, hosting, email, analytics or support providers may process or store personal information outside Australia.

The countries involved will depend on the providers being used at the relevant time. Where practicable, we will take reasonable steps to identify likely overseas locations and ensure that service providers handle information appropriately.

14. How long we retain information

We retain personal information only for as long as reasonably necessary for:

  • providing our services;
  • maintaining active listings or accounts;
  • handling enquiries;
  • maintaining transaction and payment records;
  • responding to complaints or disputes;
  • meeting legal, accounting and taxation obligations;
  • preventing fraud or misuse; and
  • enforcing contractual rights.

When information is no longer reasonably required, we may delete it, securely destroy it or de-identify it, subject to legal and operational requirements.

Information may remain temporarily in secure backups after it has been removed from active systems.

15. Data breaches

If personal information is lost, accessed without authorisation or disclosed without authorisation, we will investigate the incident and take reasonable steps to limit potential harm.

Where the Notifiable Data Breaches scheme applies and a breach is likely to result in serious harm, we will notify affected individuals and the Office of the Australian Information Commissioner as required by law.

16. Accessing your personal information

You may request access to personal information we hold about you by emailing info@wellnesscowork.com.au.

Please include sufficient information for us to identify you and locate the relevant records.

We may need to verify your identity before providing access.

In some circumstances, access may be limited or refused where permitted by law. Where appropriate, we will explain the reason for the refusal and available complaint options.

17. Correcting your personal information

You may ask us to correct personal information that you believe is:

  • inaccurate;
  • out of date;
  • incomplete;
  • irrelevant; or
  • misleading.

Clinic owners may also be able to update certain listing or account information directly.

Correction requests can be sent to info@wellnesscowork.com.au.

We will take reasonable steps to consider and respond to access and correction requests.

18. Account and listing deletion

You may ask us to:

  • close your account;
  • remove your listing;
  • delete information associated with your account; or
  • withdraw an enquiry where it has not yet been provided to another user.

Some information may need to be retained for legal, accounting, security, dispute-resolution or record-keeping purposes.

Removing an enquiry from WellnessCoWork will not necessarily remove copies already received or retained by the relevant clinic owner, room provider or another third party.

19. Marketing preferences

You may stop receiving non-essential marketing communications by:

  • using the unsubscribe link in an email; or
  • emailing info@wellnesscowork.com.au.

Unsubscribing from marketing will not prevent us from sending essential communications about:

  • your account;
  • your listing;
  • enquiries;
  • payments;
  • security;
  • service changes; or
  • legal notices.

20. Children

WellnessCoWork is intended for adults seeking or providing professional rooms and workspaces.

We do not knowingly seek to collect personal information from anyone under 18 years of age. If we become aware that information has been submitted by a child without appropriate authority, we may delete it.

21. Privacy complaints

22. Changes to this Privacy Policy

We may update this Privacy Policy when:

  • our services change;
  • new website features are introduced;
  • service providers change;

The latest version will be published on the WellnessCoWork website with its effective date.

Where changes are material, we may also notify registered users by email or through the website.
